my peers are 100% correct; what seems grossly unfair to you is not relevant. There is a huge difference between unfair and
illegal. IT is not illegal.

find a BUYER"s agent; never ever use a seller's agent to
help you do anything.

[dual agents [seller agent also rep'ing the buyer] are not permitted by law, [most all people do not
know this] to negotiate a good price for a buyer]
References :
RE broker, exclusive buyer's agency

Yes, an owner can opt to rent a home while under consideration for a short sale. With the damage and missing appliances, you should alter your offer now, because once the bank approves your offer they will not allow consideration for the damage without having to go through the approval process again.

Sounds like the Seller isn't particularly concerned about losing you as a Buyer, so I would collect my earnest money and go house shopping again with your Realtor.

It is not the Realtor in this case, unless they are the owner also. It is the owner who has hired the Realtor to sell the house, rent the house out, who has allowed the appliances to be removed. The Realtor has nothing to do with the problems you are encountering. The owner is the decision maker.

Just find another house, their are a billion on the market.
References :
Rely on your real estate agent for real estate advice (although if he was involved in your mortgage situation maybe not.....).

Rely on your tax man for tax advice. He is correct.
References :
I think you are talking about the "wash sale" rule. I'm not a tax accountant, but I can give you my understanding of that rule based on my own personal experience with reporting wash sales.

If you sell 300 shares of XYZ at a loss, then buy 100 back within 30 days, the loss on the 200 that you did not replace would be deductible. The loss on the 100 that you did replace would be added to the basis of the replacement shares.
References :
damage to the house made after you paid a deposit is probably grounds to walk away from the deal, if you wish. i'd walk if you can easily get all the money back. it's bad enough you have the typical short sale obstacles.
References :
Unfortunately, I believe that your realtor is wrong. There is a new rule about mortgage debt forgiveness not being taxable income but it only applies up to the original purchase price of the home. The amount over the $380k, is considered "income".

There is also one other caveat. If you were insolvent at the time of debt forgiveness, you should not have to pay taxes on the forgiveness. As your tax preparer about claiming insolvency on Form 982.
References :
As long as the owner gives permission. You have no say in the matter whatsoever. The bank seems to prefer to not lose money while the sale is pending. I GUARANTEE that your contract does not say that they cannot rent it.
